Terms and conditions
1. General Terms and Conditions
All deliveries, services and offers of Recognition Express Switzerland are made exclusively on the basis of these general terms and conditions, even if not expressly agreed upon again. By ordering goods or services, these conditions are deemed accepted. The buyer's own purchasing conditions are hereby contradicted. Deviations from these terms and conditions are only effective if confirmed by us in writing.
2. Offer and Contract Formation
Our product prices are non-binding. Orders are only binding for Recognition Express Switzerland after written confirmation. The information contained in our sales documents (drawings, illustrations, dimensions, weights and other services) is for guidance only and does not constitute a warranty of any characteristics, unless expressly described in writing as binding. If a buyer exceeds their credit limit when placing an order, we are released from our delivery obligation.
3. Prices
Unless otherwise agreed, quoted prices are subject to transport costs and VAT.
4. Delivery and Service Deadlines
Delivery dates and deadlines are non-binding unless otherwise agreed in writing. The specification of specific delivery deadlines and dates by Recognition Express Switzerland is subject to correct and timely delivery by suppliers.
5. Acceptance Deadline
If the buyer refuses to accept the delivered items after the expiry of a grace period, or declares that they do not wish to take delivery, Recognition Express Switzerland may refuse to perform the contract and demand damages for non-performance. Recognition Express Switzerland is entitled to claim damages either as a lump sum equal to 25% of the agreed purchase price, or in lieu of the actual damages caused.
6. Delivery
Fast delivery or as individually agreed with the customer.
Express delivery available on request.
Claims for damage, delays, losses or poor packaging must be reported immediately upon receipt of the shipment.
7. Transfer of Risk
Risk passes to the buyer as soon as the shipment has been handed over to the carrier. If the shipment is delayed or becomes impossible through no fault of our own, risk passes to the buyer upon notification of readiness for dispatch. Any assumption of transport costs by Recognition Express Switzerland agreed in individual cases has no influence on the transfer of risk.
8. Retention of Title
Delivered goods remain the property of Recognition Express Switzerland until full payment has been received.
9. Payment
Companies (registered in the commercial register): invoiced, net payable within 30 days.
For first orders, we reserve the right to require prepayment before delivery.
Private individuals will receive an order confirmation requesting prepayment. Goods will be dispatched upon receipt of payment in accordance with the dates stated in the confirmation.
10. Limitation of Liability
Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded on our part and on the part of our agents, unless intentional or grossly negligent conduct is involved. All liability for consequential damages arising from the use of the products is rejected.
11. Data Protection
Recognition Express Switzerland is entitled to process data relating to the business relationship or in connection with the buyer, whether originating from the buyer or third parties, within the meaning of the Federal Act on Data Protection (FADP). Customers' personal data is treated confidentially and is only passed on to third parties in the context of credit checks.
12. Jurisdiction
The competent court of the Canton of Vaud is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is governed by Swiss law.
Delivery and Payment Conditions
Delivery
Fast delivery or as individually agreed with the customer.
We ship ordered products primarily by mail. Shipping costs are based on Swiss Post rates.
Express delivery for next-day delivery is available on request.
In urgent cases, please always check with us whether the desired products are available in stock.
Payment Conditions
